Scope

These terms and conditions apply as an agreement between us (Hikki) and you (the Buyer), meaning the natural or legal person entering into an agreement according to point 3. The following contract text thus applies unless we have agreed otherwise - in which case such an agreement must have been made in writing before a purchase. Where the terms differ between private and business customers, special terms for business customers are specified as an appendix under each respective point.

Conclusion of Agreement

When you order from us, a purchase contract (agreement) is concluded between you and Hikki. The purchase contract is created by us accepting your order and sending you a digital order confirmation via email. The agreement is saved digitally with no expiration date.

Price

Prices in the online store are stated in either SEK, DKK, GBP, or EUR depending on which region the visitor to our website is located in. The delivery address determines which price applies to the order. If delivery is to Sweden, Swedish pricing (SEK) applies; if delivery is to one of the other EU countries, that country's prices (for example EUR/DKK) apply. Prices include Swedish VAT of 25%. We reserve the right to change prices on the website and in other channels without prior notice. The prices that applied at the time of order are the price that applies if you wish to cancel or dispute your purchase. Prices include shipping within Sweden and the EU.

Prices for products are in SEK for customers with a delivery address in Sweden, DKK for customers with a delivery address in Denmark, and EUR for customers with a delivery address within the EU mainland. The prices for each region are those reflected in the price for each currency. We reserve the right to terminate, cancel, or withdraw a purchase if we notice a discrepancy between currency and delivery address. We reserve the right to cancel orders where the product is obviously incorrectly priced.

Services such as handling, transport, and unpacking of goods are not included but can be requested and quoted separately - contact us for more information.

Discounts

If you have a discount code or other offer, these apply only according to the terms specified when the discount or offer is presented - typically in our newsletters or on our social media, or by email if you have had personal contact with us. All valid discount deductions are clearly shown in the checkout. Contact us if you have trouble activating your discount code.

Right of Withdrawal

We do our best to ensure you are satisfied with your product, but even so, circumstances may arise where you wish to withdraw from your purchase, and you have the right to do so under the distance selling regulations without providing any particular reason. You must contact us no later than 60 days after an order is placed or within 40 days after you have received your delivery - either to the delivery address you specified or to a delivery point - to be able to exercise your right of withdrawal. After you have notified us that you wish to withdraw from your purchase, you will receive a return number which you must mark on the packaging so that we can identify the return when it arrives at our warehouse. You must return the goods within 14 days after you have exercised your right of withdrawal.

Procedure for Exercising the Right of Withdrawal

After you have notified us that you wish to withdraw from your purchase, you return the product(s) in unused and undamaged condition to: Dream Logistics, Stackarpsvägen 10, Port 3-8, 264 39 Klippan, +46 36 333 34 45. When returning the goods, it must be in the original packaging to prevent damage

Should the goods not be unused or if they are damaged, Hikki has the right to make a deduction from the amount refunded corresponding to the costs we incur to restore the goods to their original condition. However, such a deduction can never exceed what you paid for the product.

If you wish to exercise your right of withdrawal, you must bear the cost of return shipping of the goods, any incidental costs for third parties (storage/repackaging/logistics/etc.), and a fee of 250 SEK (or equivalent amount in DKK/GBP/EUR) for Hikki's cost of administering the return. When you return the goods in the original packaging and bear the cost of return shipping, you as the buyer bear the cost, risk, and responsibility for transportation.

The refund will be made as soon as possible and no later than 14 days from the day we received your notification that you have withdrawn from the purchase. However, we may wait with the refund until we have received the goods back from you or until you have sent proof that you have returned the goods.

Exceptions to the Right of Withdrawal

The right of withdrawal applies only to individual consumers who purchase the goods for their own private use. For business operators, or if the goods are primarily used in connection with business activities, no right of withdrawal applies.

The right of withdrawal does not apply if the goods have been used more than is reasonable for inspection. Please note that you cannot exercise the right of withdrawal if, for example, you have burned and/or bathed in any of the products as this leaves clear traces of use and we will not be able to sell these as new after receiving them back.

Please note that failure to collect a package or to accept a delivery is not considered an exercise of the right of withdrawal.

Delivery, Transport & Damage

Delivery method, terms, delivery time, and cost vary depending on country and type of goods. We deliver to the address you specified when placing your order. Smaller products, i.e., non-pallet goods, are usually always delivered to a delivery point. At the time this agreement is written, we deliver our two bathtubs and the Faster Greta pizza oven on a pallet to your property, the rest of the assortment is delivered as packages to a delivery point.

If the goods are to be transported further according to your instructions, for example via ferry, independent freight forwarder, etc., we have fulfilled our shipping obligation when the goods are handed over to this freight forwarder. In that case, please remember to ask the person receiving the goods to inspect it for shipping damage before signing the delivery and reloading. This is important because we do not take responsibility for any shipping damage or problems that occur after the goods have been handed over, and a signed delivery is also an acknowledgment that the product has been delivered without issues.

Please note that you must be able to identify yourself when you receive the goods or when you pick it up at your delivery point. If you are unable to receive a delivery at your property, you must sign a power of attorney stating that you accept that the person delivering the goods may leave it at your property without you personally receiving and signing it - in that case, contact us well in advance (at least five working days) so we can arrange a power of attorney that you print out and sign. Then attach the power of attorney outside where the person delivering the shipment can clearly see it.

For our large products delivered on a pallet to your delivery address, they are unloaded using a tail lift directly next to the vehicle, as close to your property boundary as the freight forwarder deems possible. Transport inside your property is not included - but if you wish to purchase transport inside your property, it is important that you contact the freight company well in advance of delivery for a quote and payment terms. The freight company information is provided in the delivery confirmation email; if you cannot find this information, you can contact us and we will help you find it.

Before signing the shipping document, you have a duty to inspect to ensure there are no damages to either the goods or the packaging. If this is the case, it must be noted on the shipping document before you sign with your signature. Even though transport damage is extremely rare on our products, it can still happen, which is why it is important that you inspect the goods to ensure they are not damaged in transit before you accept the delivery. If damage should occur, it must be photographically documented to us within 3 working days before we can file a claim with the freight forwarder. Should you unfortunately receive damaged goods, you must point this out to the delivery point or freight forwarder, and you must draw up a damage report where you describe the damage and you and the driver must sign the damage report. Should the transport company deny liability for damage, contact us, and we will resolve the matter further.

Should any part or item be missing from the shipment, you must contact us as soon as possible so we can resolve it.

If you have any complaints about delivery, you must communicate this to us no later than seven days after you have received your delivery. If we have not heard from you within seven days, we assume that the goods have been delivered as desired without any issues, and there is no possibility of compensation or return due to any shipping-related circumstances.

Delivery with time commitment can be booked against an additional fee and this agreement must be made before we place the transport order. A note in the order or a message about your desired date in the online store counts as a wish, not a condition for delivery - although of course we will try to fulfill your wish as best we can. Contact Hikki before purchase if exact delivery time/date is crucial.

If you do not collect your shipment from your delivery point, receive the delivery, or arrange a power of attorney, the goods will be returned to our warehouse and you must bear the costs involved - for example, shipping/administration/storage/etc. Failure to collect or receive ordered goods is not considered an exercise of the right of withdrawal. Additional costs for this are charged to the buyer.

Free shipping applies only to delivery costs to you or a delivery point, not returns of goods (applies to both withdrawal and exchange). Free shipping applies only to deliveries where the entire route is classified as a passable road and addresses that are served by our regular freight company DHL. In cases where delivery cannot be made because the freight forwarder has determined that a route is impassable (usually not a public road or poor forest road), or if the address is not within the freight operator's delivery area, you must bear any costs for handling and storage of the goods from the terminal where the freight forwarder chooses to unload the goods. In that case, you must also collect the goods at that terminal, or arrange for new transport from the terminal to your door. Contact Hikki before purchase if you suspect that your route is not classified as a passable road. Here you can see which locations are served by DHL.

Free shipping applies only within the country, and if the above terms are met.

Exchange

Hikki has no obligation to exchange a non-defective product, but we will do everything we can to try to accommodate you and find a solution that we are both satisfied with, if possible. The right of withdrawal is not affected by this. In the event that the goods are to be returned for an exchange, the terms in point X apply, unless otherwise agreed.

Payment

We have several payment options in our online store, and the terms differ between the different providers, so we must refer to each provider's terms page: : Klarna | Paypal | Shop Pay (Shopify) | Google Pay |

We only use established, trusted providers with a long history of handling online payments and e-commerce. What they all have in common is that payments made with credit or debit cards are always encrypted, so you can feel confident shopping with us.

Card Payment

When paying by card, the card will be charged on the day the order begins to be manufactured or packaged at the factory. However, an amount corresponding to the purchase price will be reserved on the card at the time the order is placed.

You must have the right to use the debit or credit card that you specify at payment.

Retention of Title

The goods are our property until we have received full payment from you. If you choose to pay in installments via Klarna, we consider the property to belong to you, provided that Klarna has assessed your creditworthiness and approved the purchase, even if the installment payment period is still ongoing.

Warranty and Claims

We provide a 24-month warranty on all products. If you have a problem with your product, you must contact us within 24 months from the date of your order.

In addition to 6 months of statutory consumer protection (Consumer Purchase Act section 20a), we provide a warranty of an additional 18 months to private customers, which means a total warranty period of 24 months from the date of purchase. For business customers, a 6-month warranty period applies regarding original defects.

You are entitled to warranty if the product has any manufacturing or material defects and you have assembled it according to the included instructions. If instructions are missing, you can download them from the product pages at www.hikkisweden.com. Always read the instructions before assembling or using the product.

If you are entitled to warranty, we will, as soon as we can, do one of the following:

(1) repair the product at no cost (2) replace the defective product or part with a new or equivalent product or part (3) If options 1 or 2 are not feasible, refund the price of the product at the time of order. Hikki reserves the right to decide which of the three options will be used.

Our liability for damages can never exceed the value of the part that is defective.

Hikki can never be held liable for indirect damage such as operational downtime, lost profit or revenue, or other indirect damage regardless of whether the buyer has been negligent or not.

Please note that the warranty ends if you make adjustments or modifications to the product without us having written approval or instructing you on how to do so. Modifications required for any accessory to function do not, however, affect the warranty - for example, you must screw in brackets in the Bohemian frame to be able to attach the cover or protection.

If you need to send any product to us after we have agreed to resolve a warranty issue with a repair, it is important that you package it carefully and in the same way as it was when you received it. We pay for all shipping costs (but only if the entire route is a passable road) in a warranty case, whether you send in goods or components for repair or if we send you new goods or components from our warehouse.

Please note that the freight forwarder must be able to access your package easily, so make sure it is as accessible as possible - preferably in the same place it was unloaded.

Handling of Personal Data - Confidentiality

By "personal data" is meant all types of information that identifies you as an individual or relates to an identifiable individual, such as name, personal number, postal address, phone number, email address, and card information.

When you order from us, you give us consent to store, process, and use the personal data and information that is reasonable for the customer relationship and for order processing, payment processing, delivery handling, communication, information, and newsletters.

We also share necessary data with third parties so that they can fulfill their obligations - for example, a freight forwarder needs your address and contact information, and our order system saves your order history, any notes, and so on. We save the data for the time being and do not use it for any purposes other than in our relationship with you.

If you want us to delete your contact information or stop sending you our newsletters, you can either contact us, and for newsletters there is an unsubscribe link at the bottom of the email. However, we must keep your information until we have delivered your goods, and an order confirmation/invoice must be saved according to accounting law, even if we have deleted you from our customer register and our mailing list for our newsletters.

Governing Law and Dispute Resolution

Subject to the extent that mandatory law does not provide otherwise, the agreement is governed by Swedish law and disputes shall be resolved in the first instance through mediation where each party at its own expense appoints a mediator. If mediation is unsuccessful, the dispute shall be resolved according to Swedish law in Swedish court.

Where class action is permitted under national law, the buyer agrees with Hikki that each party may only bring claims against the other in their own individual capacity, not as a defendant or class member in a class action. No arbitrator or judge may combine more than one person's claims or otherwise conduct any form of class action for review unless the buyer and Hikki agree otherwise.

Hikki's Liability

Hikki disclaims all representations and obligations, express or implied, that are not expressly governed by these terms and conditions or follow from mandatory law. Hikki is not liable for direct or indirect physical, personal, or property damage resulting from its goods or services or lack of ability to use these.

The buyer agrees to indemnify and hold Hikki and its employees, owners, and agents harmless from all claims, demands, losses, liabilities, and expenses (including legal fees) arising out of or in connection with: (i) the buyer's use of the goods and services or goods and services obtained through the buyer's use of the goods and services, (ii) the buyer's breach of or violation of any of these terms and conditions, (iii) Hikki's use of the buyer's personal data, or (iv) the buyer's violation of third-party rights, including third-party suppliers.

Force Majeure

We are released from fulfilling delivery if proper fulfillment is prevented by a circumstance beyond our control that we reasonably could not have expected when the agreement was concluded and whose consequences we reasonably could not have avoided or overcome, such as labor dispute, fire, accident, war, pandemic, government decision, or other circumstance that has been beyond our control and that substantially affects our proper fulfillment of the agreement.
